The labels are not policed and many firms use both about themselves. SBD Marketing calls itself a marketing company and does web design, SEO, AI search and audits, a narrower brief than “marketing agency” usually implies, applied to one practice area.
Which a defense firm needs first
Almost always search, and for a structural reason. A criminal defense firm's prospective client is not being persuaded to want a lawyer; they already have a charge. Demand exists and is being allocated. The question is whether the firm is visible at the moment of allocation, which is a search problem before it is a brand problem.
Brand work matters later, and it matters most for the part search cannot do: being chosen once found, and being remembered by the people who refer: bondsmen, former clients, other attorneys. A firm invisible in the map pack should not be buying brand video.

A note on bundling
The widest brief is not automatically the best value. A bundle covering nine services usually means one or two are done well and the rest are filled. For a defense firm the two that matter most (profile configuration and charge pages) are also the cheapest to do properly and the easiest to leave half-done inside a large retainer.
Why the terms overlap
Nothing stops a marketing agency from doing excellent search work, and nothing stops an SEO company from offering advertising. The labels describe emphasis and not capability, which is why sorting firms by what they call themselves fails.

A marketing agency covers a wider brief that may include paid advertising, social media, branding, print and email, with search as one line among them. Both are legitimate businesses and they solve different problems.
The failure mode for a defense firm is buying the second while needing the first. A retainer split across six channels puts a fraction of the budget on the surfaces where defense clients are actually decided, and it produces reports full of activity on channels that do not sign matters.
Which a defense firm needs
The answer follows from where defense clients come from. Urgent, charge-specific, locally-bounded queries are decided in the map pack and the organic listings beneath it, and a family member searching at eleven at night is not reached by a social media calendar.
That argues for concentration. A firm with a limited budget gets more from the search surfaces done properly than from six channels done thinly, and the case for the wider brief arrives later, once the search surfaces are held.

Telling them apart in a conversation
Ask what proportion of the retainer goes to search work, and ask which surfaces specifically. An answer naming the profile, the charge pages and the measurement is describing search work. An answer listing channels is describing a marketing retainer.
Ask what the reporting will show. Grid-measured visibility on named queries is a search deliverable; impressions and engagement across channels is a marketing one, and it will not tell a defense firm whether it is findable when somebody is arrested.
Like-for-like check
